In 2021, the Virginia General Assembly created a new section, Va. Code § 2.2-3706.1 that makes criminal incident information and criminal investigative files subject to FOIA, including reports, notes, electronic communications, and any documents, for a criminal investigation or proceeding that is “not ongoing.” This amendment, which takes effect July 1, 2021, has raised several questions from prosecutors and law enforcement.
